1. Acceptance of Terms

By accessing and using the website and services provided by WhichNotes ("we," "us," or "our"), accessible from https://whichnotes.io (the "Service"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Service.

2. Description of Service

WhichNotes is an AI-powered personal knowledge management system designed to help users organize, analyze, and visualize their notes and ideas. The Service includes features such as automatic summarization, topic extraction, and a visual knowledge graph connecting related notes.

3. User Accounts

3.1 Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

3.2 Security

You are responsible for maintaining the confidentiality of your account credentials (email and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Eligibility

You must be at least 13 years old (or the minimum legal age in your country) to use our Service. If you are under 18, you may only use the Service with the consent of a parent or legal guardian.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer both free and paid ("Premium") subscription plans. The features and limits of each plan are described on our pricing page.

4.2 Billing and Renewal

Paid subscriptions are billed in advance on a recurring monthly basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. We use Paddle as our Merchant of Record for all payments.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period. You will continue to have access to Premium features until the end of the period, and no refunds will be issued for the remaining days, except as required by applicable law.

4.4 Price Changes

We reserve the right to change our subscription fees at any time. Any price changes will be communicated to you in advance and will take effect at the start of the next billing cycle.

5. Artificial Intelligence (AI) Disclaimer

IMPORTANT: Our Service utilizes Artificial Intelligence (AI) technologies to analyze your text, generate summaries, and identify connections between notes.

  • No Guarantee of Accuracy: AI is an evolving technology and may produce output that is inaccurate, incomplete, or misleading ("hallucinations"). We do not guarantee the accuracy, truthfulness, or usefulness of any AI-generated content.
  • User Responsibility: You are solely responsible for verifying the accuracy of any AI-generated summaries, connections, or other outputs before relying on them. You should not use AI outputs as the sole basis for critical decisions (e.g., legal, medical, or financial).

6. User Content

6.1 Ownership

You retain full ownership of all notes, text, files, and other content ("User Content") that you submit to the Service. We do not claim ownership rights over your User Content.

6.2 License to Us

By submitting User Content, you grant WhichNotes a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, create derivative works (such as summaries and embeddings), and display your User Content solely for the purpose of providing, operating, and improving the Service for you.

6.3 Privacy

We do not sell your User Content to third parties. Our use of your data is governed by our Privacy Policy.

7. Prohibited Uses

You agree not to use the Service:

  1. For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.
  2. To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  3. To upload or transmit viruses, malware, or any other type of malicious code.
  4. To attempt to reverse engineer, decompile, or disassemble any portion of the Service.
  5. To use the Service to generate or disseminate spam, misinformation, or hateful content.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of WhichNotes and its licensors. The Service is protected by copyright, trademark, and other laws.

9. Disclaimer of Warranties ("AS IS")

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF RESULTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WHICHNOTES, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE (12) MONTHS.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms or use of the Service shall be resolved in the courts of Istanbul, Turkey.
